In Ukraine, on July 1, 2021, the agricultural land turnover market opens. From today, Ukrainian citizens become full-fledged owners of their property, having received the right to freely sell and buy land plots.
President Volodymyr Zelenskyy was the initiator and engine of land reform in Ukraine, which the previous government could not implement for more than 20 years.
“A transparent land market is what we promised the citizens of Ukraine and what we are doing. We did it just for the people, taking into account their comments and wishes, ”said Volodymyr Zelenskyy during his speech at the Ukraine 30. Earth All-Ukrainian Forum in May.
Throughout the ban on the sale of agricultural land, Ukrainian landowners, possessing hectares of fertile land, lived in poverty for years, unable to use them in full. Finally, they can dispose of their own property for the benefit of themselves and their families.
At the same time, during the years of the moratorium, about 5 million hectares of state land were illegally appropriated, which is equal in area to almost two Crimean peninsulas.
From now on, all citizens of Ukraine, territorial communities and the state have the right to buy land. The notary will check the buyer and the correctness of the submitted documents. In case of non-compliance with the requirements, the notary is obliged to refuse the state registration of the purchase and sale agreement.
However, until January 1, 2024, there is a limitation - one citizen of Ukraine can own agricultural land with a total area of no more than 100 hectares.
To sell a share, a landowner must follow a few simple steps:
1) Check the cadastral number on the Public cadastral map map.land.gov.ua.
2) Determine if there are pre-emptive purchasers. By law, this is the tenant of your land plot. The owner of the land must first of all offer to purchase the land to the tenant or to the person to whom the tenant has transferred his preemptive right to purchase.
4) Understand how the price is formed. Experts advise against rushing to sell shares immediately after the market opens, because over time market prices will rise, and the average rent will increase accordingly, so it will be more profitable to lease plots.
In addition to the sale, the land plot can be rented out and receive a constant income; to establish a farm on this land and develop your own business; use the site as collateral for a loan and receive funds for the development of your farm or for personal purposes, etc.
Also, land can be donated or inherited, and the new owner will have full owner rights to it.
